If you want to use a song from a band on Kung Fu records, including the
Vandals, please read the following carefully.

1. If you are making your first comp. (compilation album) forget it. We have
had such bad experiences with people making their first comps that we have
to draw the line here. People making their first anything don't know what
they are doing. It's great that you're trying to do something but we don't
have time to teach you the record business and that is what you need to
learn before you start selling copyrighted masters (the right way) so please
learn it first, then contact us. So if this is your first comp, you do not
need to go further and please do not attempt to contact us further.

2. Benefit comps: We are not impressed by your plan to donate money to
charity. Every year Kung Fu does the Phil Hendrie Charity CD, from which
100% of the gross proceeds go to the My Friend's Place charity helping to
take care of Hollywood's gutter punks and street kids. 100% means that when
a CD is sold ($20.00) the entire amount goes to the Charity because we pay
ALL the manufacturing costs ourselves. It's great that you are going to
donate a portion of the proceeds from your comp to charity but as you can
see, it's not going to be the deciding factor for us to be involved.
Political beneficiaries almost never fly. We all want to change the world
but it's too hard to check out whether these organizations are actually
attempting to change the world for the worse, so we'd rather not spend the
time and resources doing it.


3. Despite what any band tells you, ALL comps and tribute albums are
extremely annoying to the bands that are capable of helping your comp and
their record labels. The band wants to be nice to you when you ask them but
if they are popular enough to help your comp that means they get asked
about 5 to 10 times per week to do a comp or a "tribute" album. If you were
asked 5 to 10 times a week to do a comp for someone you barely know, you
would hate them to. Make no mistake, the bands that you really want hate
them. Some bands are helped by your comp, they might like it, their labels
might like it, but the bands that help drive the sales (and their labels)
always hate it. So if you really want to do this, keep in mind you are now
in the category of "annoying person" in connection with the bands that you
supposedly like a lot.

The fact that the band was nice to you when you asked them to participate
means nothing. Most bands have been burned by bitter comp makers who talk an
amazing amount of s**t if the band says no.


4. You must be able to articulate the marketing and distribution plan you
have for your comp. This should be communicated to Kung Fu in a document
faxed to the attention of "Comp Request Dept." at 1-323-468-6959.
This document should contain a list of all your distributors worldwide,
confirmed and proposed participants, a list of all your label's prior
releases, and a brief bio on your label. It should also contain the amount
of money that will be committed by you to marketing your comp.

5. You must fax separate adequate licensing agreements for the Master AND
the Composition. To do this you must hire an attorney or be very familiar
with the legal aspects of releasing copyrighted sound recordings. This is
where most people blow it so if you don't know what all this means,
familiarize yourself with it thoroughly before faxing anything or we will
probably ignore any and all further faxes. The maximum term on this
agreement should be no longer than 5 years or it will be thrown away.

6. Payment: All the Kung Fu and Vandals Masters were very expensive to
record, are of a high quality, and are valuable in the marketplace. If you
think you should pay nothing to the author of the song, and/or nothing to
the owner of the Master Recording, you need to provide us with a breakdown
of where you think the money that you receive for selling these recordings
should go. Supplying free copies of the comp to the band or label is more of
a burden than a form of payment for Kung Fu and all it's bands so if that's
the plan, don't bother. If you don't know the difference between the
composition and Master Recording, you'd better learn it first. That's what
wastes most of our time and we can't afford to devote resources to it
anymore because we'd rather be servicing our bands with that time and money.

If you still think you have a compilation album that meets the requirements,
good luck. You have our fax number and maybe you will have the next FAT 30
second comp. (An example of a fantastic comp that was done correctly and
benefited the entire world. )Remember, just because you did a comp with
another label and they were satisfied with the amateur technique, doesn't
mean we will be into it at all. Once you learn how to do all this properly,
it will make dealing with all labels easier for you in the future and you
will hopefully thank us for forcing you to do things the right way.

7. Finally, do not follow up on your request, especially with a phone call.
We do not take phone calls in connection with comp requests. That's why we
went to the trouble to make this page. If you think we didn't get your
request, you can fax it again but we probably got it and don't want to do
it. Faxing it more than twice is a big mistake. We don't have time to
respond to all the requests we get so if you don't hear from us, it means
no. Please do not bug the bands personally about it. We pass all the
qualifying comp requests by them ourselves. The more you become a pest, the
less likely it is going to happen.
